Guardianships 

A guardianship order grants someone the authority to make ongoing decisions on behalf of an adult who lacks the capability to protect, safeguard, and make decisions regarding their own financial and personal welfare. This order is issued by a sheriff and typically remains in effect for a predetermined period, such as 3 years. An adult refers to an individual who is 16 years or older. However, if needed, a guardianship application can be submitted 3 months prior to a child turning 16 to ensure the order is in effect by their 16th birthday.

A guardianship order can be granted to handle property and financial matters, personal welfare, or a combination. We can provide legal advice if you consider applying to the Sheriff Court for an order.
